JK Productions – Third-Party Labor Providers
This policy governs the provision of labor by third-party staffing organizations, including union hiring halls and dispatch entities (“Labor Provider”), for services performed on behalf of JK Productions.
Due to the time-sensitive and mission-critical nature of live event and broadcast production, confirmed labor dispatches constitute binding operational commitments.
This policy applies to any labor supplied to JK Productions by a Labor Provider once:
A labor request has been issued; and
The Labor Provider confirms dispatch of personnel
Upon confirming a dispatch, the Labor Provider represents that:
Assigned personnel are available for the full scheduled call.
Personnel are qualified to operate the designated equipment or fulfill the assigned role.
Personnel have been informed of call times, location, and reporting requirements.
Confirmed personnel are considered contractually committed for the scheduled duration.
Live production operations are schedule-critical. Delays or absence materially impact safety, technical execution, and contractual performance.
Personnel are required to report ready to work at the scheduled call time.
If dispatched personnel fail to report at the scheduled call time, and the delay is not caused by JK Productions or venue-related access restrictions:
The Labor Provider shall be billed at two (2) times the applicable hourly labor rate for the duration of the delay, up to two (2) hours.
After two (2) hours past scheduled call time, the personnel will be deemed a No-Show.
This charge reflects operational disruption, standby costs, and schedule impacts.
If dispatched personnel fail to report within two (2) hours of scheduled call time without prior written cancellation or approved replacement:
The Labor Provider shall be responsible for:
Three (3) times the full scheduled labor rate for the assigned shift, plus
The full rental cost of any equipment assigned to that position for the scheduled period.
This charge reflects:
Loss of production continuity
Emergency staffing efforts
Idle specialty equipment
Contractual exposure to JK Productions
Operational risk and disruption
If JK Productions secures replacement personnel, standard labor charges for the replacement will also apply.
Certain roles are paired with specific technical systems (including but not limited to replay servers, LED processors, broadcast switchers, robotics systems, audio recording infrastructure, and specialty camera systems).
Where personnel are dispatched for equipment-specific roles:
Equipment is reserved exclusively for the assigned position.
Idle equipment resulting from late arrival or non-attendance remains billable.
Equipment may not be reassigned without operational approval.
If dispatched personnel become unavailable:
The Labor Provider must immediately notify JK Productions.
The Labor Provider shall make commercially reasonable efforts to supply qualified replacement personnel.
Emergency replacement differentials or expedited sourcing costs may be billed to the Labor Provider where permitted by applicable agreements.
The Labor Provider acknowledges that actual damages resulting from late arrival or non-attendance in live production environments are difficult to quantify due to cascading operational impacts, contractual penalties, and reputational harm.
Accordingly, the charges set forth herein represent agreed-upon reasonable liquidated damages and are not intended as a penalty.
Charges assessed under this policy shall be invoiced to the Labor Provider and are due pursuant to agreed payment terms.
Failure to remit payment may result in:
Suspension of future labor requests
Withholding of future bookings
Legal recovery action
Confirmation of dispatch constitutes acknowledgment and acceptance of this policy.
